Off The Wall Kids App — Terms of Use

1. Eligibility and your account

• You must be at least 18 years old and a parent, guardian, or caregiver to use the app.
• Provide accurate information and keep it up to date.
• You are responsible for activity on your account. Keep your phone and email secure, and tell us if you think someone else has accessed your account.
• Information about children may only be added by their parent or legal guardian, or with their permission.

2. Bookings, payments, and waivers

Bookings, deposits, payments, cancellations, and refunds made in the app are governed by the booking terms and policies shown when you book, and every participant must be covered by a valid OTWK waiver. Prices, availability, and food or package inclusions are confirmed at the time of booking. Card payments are processed by Helcim under its own terms.

3. Arcade credits, e-tickets, and prizes

• Arcade credits purchased in the app may be used only to activate physical arcade machines at the Off The Wall Kids venue. They do not unlock digital games, features, or content in the app.
• The price and number of credits are shown before purchase. Card payments are processed by Helcim. Except where required by law, completed credit purchases are final; contact us if you were charged but the credits were not added correctly.
• Credits and e-tickets have no cash value, may not be resold, and may not be transferred between customer accounts unless OTWK expressly allows it.
• E-tickets are earned from eligible physical arcade machines and may be redeemed only for physical prizes at the venue prize counter.
• Machine and prize availability can change. Prize images are previews, quantities are limited, and the e-ticket amount displayed at the prize counter at the time of redemption applies.
• Suspected fraud, payment reversals, machine errors, or misuse may result in a balance correction or account suspension while we investigate.

4. Community rules

Before posting in the community you must accept our Community Guidelines, which are part of these terms. You agree not to post or send anything that:

• bullies, harasses, threatens, or discriminates against anyone, or is hateful;
• is sexual, violent, graphic, or otherwise objectionable;
• shares a child’s personal information or images of other people’s children without permission;
• is spam, advertising, a scam, or an offer to sell something;
• is illegal, encourages illegal or dangerous activity, or infringes someone else’s rights;
• impersonates another person or OTWK staff.

There is no tolerance for objectionable content or abusive users.

5. Moderation, reporting, and blocking

We filter objectionable language, and you can report any post, reply, or user and block anyone. We review reports promptly — usually within 24 hours — and may remove content, remove groups, and suspend or permanently ban accounts that break these terms, with or without notice. Group creators may delete their own groups. We are not obligated to monitor all content, and we are not responsible for content posted by other users, but we will act on reports.

6. Your content

You keep ownership of what you post. You give OTWK a non-exclusive, royalty-free licence to host, store, display, and remove your content as needed to operate the app and keep it safe. You confirm you have the right to share anything you post. Content you delete, or that is removed, may be kept for a limited time as described in the Privacy Policy.

7. Acceptable use

• Do not misuse the app: no hacking, scraping, automated access, or attempts to bypass security, filters, blocks, or bans.
• Do not use the app to contact people who have blocked you or to collect other users’ information.
• Do not use the app for any commercial purpose without our written permission.

8. Our app and content

The app, the Off The Wall Kids name and logos, and all content we provide belong to OTWK or our licensors. We give you a personal, non-transferable, revocable licence to use the app for its intended purpose.

9. Ending your account

You can delete your account at any time in the app (Account tab → Delete my account) or at offthewallkids.ca/app/delete-account. We may suspend or end your access if you break these terms or if we stop offering the app. Sections that by their nature should continue (such as content licences, disclaimers, and limits of liability) survive.

10. Disclaimers

The app is provided "as is" and "as available". We do our best to keep it accurate and running, but we do not guarantee it will always be available, error-free, or secure. Meet-ups and playdates arranged through the community are between parents — use good judgement and supervise your children at all times. Visits to our facility remain subject to our waiver and facility rules.

11. Limitation of liability

To the extent permitted by law, OTWK is not liable for indirect, incidental, or consequential damages, or for the conduct or content of other users, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us through the app in the three months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

12. App stores

If you downloaded the app from the Apple App Store or Google Play, these terms are between you and OTWK, not Apple or Google, and OTWK is responsible for the app and its support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You must also follow the store’s own terms of service.

13. Governing law and changes

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and disputes will be handled in the courts of Ontario. We may update these terms; we will change the effective date and, for significant changes, let you know in the app. Continuing to use the app means you accept the updated terms.
